IMPORTANT NOTICE
Our services are offered exclusively within the Republic of South Africa. By accessing or using this website and/or opening a Bullion Box Account, you agree to be bound by these Terms and Conditions.
1. Parties
1.1 Bullion Box (Pty) Ltd (“Bullion Box”, “we”, “us”, “our”) is the provider of the goods and services described in these Terms.
1.2 You (“the Customer”, “Account Holder”) are the person accessing the website and/or placing an Order.
2. Definitions
Unless the context indicates otherwise:
- Agreement means these Terms and Conditions together with any Order-specific terms agreed from time to time.
- Account or Bullion Box Account means the account opened by you upon registration on our platform.
- Account Holder means the registered customer reflected in our records.
- Beneficiary means a natural or juristic person validly nominated to inherit rights and assets in an Account upon death or incapacity, as set out in clause 16.
- Business Day means any day other than a Saturday, Sunday, or public holiday in South Africa.
- Business Hours means our normal operating hours as published on our website.
- LION, BULL, FALCON means the intangible representation of a part payment toward the purchase of a Krugerrand, each representing 1/100 of the applicable Krugerrand denomination value at the Then Current Gold Price.
- Dormant Account means an Account with no activity for a continuous period of 24 months.
- Force Majeure Event means any event beyond our reasonable control, including acts of God, war, civil unrest, strikes, pandemics, governmental actions, or market disruptions.
- Fraudulent Activity means any unlawful, dishonest, or abusive use of the platform.
- Goods means Krugerrands and/or any parts thereof, including LION, BULL, FALCON.
- Order means a request submitted by you and accepted by us for the purchase of Goods.
- Order Date means the date on which an Order is accepted and your Account is debited.
- Purchase Date means the date on which cleared funds are received by us.
- Services means any services provided in connection with your Orders or Account.
- Then‑Current Gold Price means the prevailing gold spot price plus 8.5% at the relevant date and time.
- Writing includes electronic and physical written communication.
3. Interpretation
3.1 This Agreement is governed by the laws of the Republic of South Africa.
3.2 Headings are for convenience only and do not affect interpretation.
3.3 No provision will be interpreted against the drafting party.
3.4 References to persons include natural and juristic persons.
3.5 Time calculations are based on South African Standard Time (GMT +2).
4. Application and Capacity
4.1 These Terms apply to all Orders and use of the platform.
4.2 Special conditions agreed in writing for a specific Order prevail in case of conflict.
4.3 By using the platform, you warrant that you are at least 18 years old and have full legal capacity.
4.4 Persons under 18 years of age may not open an Account.
5. No Financial or Investment Advice
5.1 Bullion Box is not a registered financial services or credit provider.
5.2 All information provided is for general information purposes only and does not constitute financial, investment, or tax advice.
5.3 No service constitutes the provision of credit or acceptance of deposits.
5.4 You use the platform entirely at your own risk and indemnify us against losses arising from decisions made based on our services or information.
6. Information Processing and Privacy
6.1 We process personal information in accordance with applicable South African data protection laws.
6.2 By opening an Account, you consent to the collection, use, and storage of your personal information for purposes including registration, identity verification, order fulfilment, communication, compliance, and marketing (where legally permitted).
6.3 We may share information with service providers, group entities, and professional advisors strictly on a need‑to‑know basis and subject to confidentiality obligations.

7. Geographic Limitation
7.1 Services and deliveries are limited to the Republic of South Africa.
7.2 Orders with delivery or billing addresses outside South Africa will be rejected.
8. Orders
8.1 Any request to purchase Goods constitutes an offer by you.
8.2 An Order becomes binding only once accepted by us and reflected in your Account.
8.3 Acceptance occurs once the purchase amount is successfully credited to your Account.
9. Goods and Pricing
9.1 We sell Krugerrands and/or parts thereof in the form of LION, BULL, FALCON.
9.2 Prices are linked to the gold price and fluctuate accordingly.
9.3 Fees, including platform, subscription, or administrative fees, may apply and are published on our website.
9.4 All funds received are first allocated to fees before being applied to the purchase of Goods.
10. Payment
10.1 Only payment methods listed on our website are accepted.
10.2 Cash payments are not accepted.
10.3 Payments made more than 12 hours after an Order may be recalculated due to gold price fluctuations.
10.4 VAT is applied in accordance with South African tax
law.
11. Ownership
11.1 Ownership of a Krugerrand (full, half, or quarter) passes only upon the successful acquisition of 100/100 corresponding units.
11.2 Ownership transfers once cleared funds are received.
12. Options After Purchase
You may elect to:
- Cash out at the Then‑Current Gold Price; or
- Collect, receive delivery, or store a Krugerrand with our approved partners (fees may apply).
13. Cash‑Outs
13.1 Cash‑outs are subject to verification and compliance checks.
13.2 Payments may take up to five Business Days.
13.3 Only individual bank accounts in the Account Holder’s name are permitted.
14. Krugerrands
14.1 Each Krugerrand is allocated a serial number once fractions are complete.
14.2 Storage is free until delivery or cash‑out is elected.
14.3 Delivery is limited to South Africa and undertaken at your risk once handed to the courier.
15. Beneficiaries
15.1 Account Holders may nominate one or more Beneficiaries.
15.2 Beneficiaries acquire rights only upon death or
incapacity and subject to legal verification.
15.3 If no Beneficiary is nominated, distribution follows South African succession law.
16. Purchasing for Third Parties
16.1 Goods may be purchased for other Account Holders via Bullion Box Voucher Codes.
16.2 Voucher Codes are valid for three years from the date of purchase.
17. Access and Security
17.1 You are responsible for safeguarding your login details.
17.2 We are not liable for unauthorised activity conducted using your credentials.
18. Marketing
18.1 By providing your details, you consent to receive marketing communications, subject to your right to opt out at any time.
19. B2B Partners and Agents
19.1 Bullion Box may engage partners and agents.
19.2 No partner or agent may bind Bullion Box unless authorised in writing.
19.3 All claims arising from platform use lie solely against Bullion Box.
20. Warranties and Indemnities
20.1 We warrant that we operate lawfully and with reasonable skill and care.
20.2 You warrant that your use of the platform is lawful and indemnify us against third‑party claims arising from your breach.
21. Breach, Suspension, and Termination
21.1 We may suspend or terminate Accounts in cases of breach, fraud, or unlawful use.
21.2 Termination may occur with immediate effect upon written notice.
22. Dormant Accounts
22.1 Accounts inactive for 24 months may be classified as Dormant.
22.2 Dormant Accounts remain your property and may be reactivated upon verification.
23. Tax and Regulatory Matters
23.1 You are solely responsible for all tax obligations.
23.2 Services may be amended to comply with changes in law or regulation.
24. Intellectual Property
24.1 All platform content and intellectual property belong to Bullion Box or its licensors.
24.2 You are granted a limited, non‑exclusive licence for personal use only.
25. Limitation of Liability
25.1 Our total liability is limited to the value of holdings in your Account at the time of the claim.
25.2 We are not liable for indirect or consequential damages.
26. Dispute Resolution
26.1 Disputes will first be resolved through negotiation, then mediation, and finally arbitration under AFSA rules.
26.2 Either party may seek urgent interim relief from a court.
27. General
27.1 This Agreement constitutes the entire agreement between the parties.
27.2 Amendments may be made upon notice and apply to future Orders.
27.3 You consent to the jurisdiction of the Magistrate’s Court, without limiting access to other competent courts.
